OK, here's the correct answer: "We have no legal case, so we will lose, but it's just not fair ... blah blah.

Normally I would not have any sympathy for such a case, but the letter does seem to establish that Warner deserves to have the spoils from this film. Unfortunately all human societies are imperfect, and what is legal is not always just.
