He actually pled guilty to "one count of surveilling unclothed persons," which doesn't seem like it could be a crime. I have watched people skinny-dipping in hotel pools, for example.
What he actually did, however, does seem like a crime. He didn't just use the ladder to get a better vantage point from his own property. He actually placed said ladder against their house and climbed it to look in their bedroom window, Belushi style!
